Aggressively Protecting Your Rights

There were more than 24,000 crashes in Ohio in 2017. According to the Ohio State Highway Patrol, of those crashes, 400 proved fatal and thousands were injured. These numbers show us that driving can be a dangerous prospect. What the numbers don’t show us, however, is all the pain, suffering and inconvenience accident victims often must endure.

Whether you are riding for pleasure or to get around town, motorcycles can be a source of open air thrills and excitement. But when other motorists speed, are distracted, or fail to yield to bikers, accidents can happen. Because motorcycles don’t offer the same level of protection as cars do, collisions often cause serious, permanent, and even life-threatening injuries to riders.

If you have been injured in a bicycle accident caused by a negligent motorist, the law protects you. Car and truck drivers are required to share the road not only with other motor vehicles, but with cyclists. Cyclists have a legal right to be on the road, but many motor vehicle drivers ignore the rights of cyclists or fail to look out for them or be attentive and responsible on Ohio roads.

Under Ohio law, if you are injured at your place of work, you could be entitled to workers’ compensation benefits. This benefit is designed to cover an injured employee’s lost wages as well as the costs associated with medical care and rehabilitation. Regardless of the type of injury, I can help with your claim.

Property owners are responsible for maintaining safe property conditions and keeping their guests, commercial patrons, and others protected from the risk of injury when they are on their premises. If property conditions are unsafe or security is not adequately provided, an innocent person could be injured or killed. If you were hurt—or a family member was killed—on someone else’s property, you may have a claim against the property owner.

Animal attacks can cause serious, life-changing injuries. In addition to the pain of stitches and surgery, animal bite victims often face lifelong fears of animals as well as self-esteem issues due to scarring and disfigurement.  These victims are often small children who have sustained injuries to the face. Sometimes, injuries occur while being chased by a dog without ever being bitten. These types of injuries are also compensable.

Accidents where pedestrians get hit by a motor vehicle driver or a motorcyclist are more common than you might think. In the U.S., thousands of pedestrians are hit by motor vehicles every year, resulting in nearly 5,000 deaths. Pedestrian accidents don’t only happen to people crossing a road without using a crosswalk or only to children.

Whether it is for long-term care or short-term recovery, when your loved one is in a nursing home facility, you expect that he or she will receive adequate medical care and attention. Unfortunately, some nursing homes are understaffed and under-budgeted, which can lead to resident neglect.

Medical malpractice happens when a healthcare provider, such as a doctor, nurse, or surgeon, causes injury to a patient as a result of negligence or wrongdoing. Whether it is an error prescribing medication, incorrect diagnosis of illness or injury, or a surgical mistake, it can be considered medical malpractice.

Police officers have a duty to protect citizens. The law allows officers to use the requisite amount of force needed to diffuse a dangerous situation.  However, there are the rare circumstances where police officers use what is considered “excessive force,” that can have bad or even tragic consequences.  When excessive force is used by a police officer, it is a violation of a person’s civil rights.  Financial compensation may be available to the victim if substantial physical injury or death results.

Even the most chronic or hardened inmates have basic rights that are protected by the U.S. Constitution. If you are facing incarceration, or if you have a family member or friend who is in prison or jail, you should know about inmates’ rights.

Protect yourself from liability on Halloween

Tonight is the night that you might have lots of little ones visiting your front door to get candy.  Halloween is a wonderful time of year.  However, what most people do not think about is that when the trick or treaters come  onto your property, you could potentially be held liable for any injuries they sustain.  If your porch light is on and you welcome the children to the front door, the children … Read more

Risks involved in driving other people’s vehicles.

Talk to your teens about the risks involved in driving other people’s vehicles. In my practice, I see teens letting their friends drive their cars and then getting into accidents. Some teens believe that if they cause an accident while driving their friend’s car, they will not be responsible because the car is insured. This is not always the case. In general, your child (and your auto insurance) will be … Read more

Why you may not be able to find an attorney willing to take your medical malpractice case

I get many calls from people seeking compensation against a doctor or other health care provider for medical malpractice or negligence.  Common scenarios are failure to diagnose an illness, mistakes made during surgery, or failure to properly treat an illness. Some callers are frustrated because they cannot find an attorney willing to take their case.  Just because an attorney will not take your case does not necessarily mean that you were … Read more

Do you need errors and omissions (E&O) insurance?

Professional liability insurance, called errors and omissions or malpractice insurance, covers businesses and individuals who offer advice or professional services, such as doctors, lawyers, architects and accountants. The coverage protects policyholders from financial losses due to negligence. Commercial general liability insurance typically covers bodily injury and property damage. E&O insurance differs in that it covers claims of negligence or harm that results in financial losses or other damages. Whether you’re … Read more

Do you have an "attractive nuisance" on your property?

Anything that is both attractive and dangerous to curious children can be considered an attractive nuisance, making you potentially liable in the event that these objects cause an accident. Common attractive nuisances include farm equipment, unguarded swimming pools, open pits or holes, abandoned appliances, old vehicles, manmade features and trampolines. The logic is that even if a child trespassed on your property, you might still be liable if you failed … Read more

Slipping and Falling on Ice and Snow

It’s a winter day in Northeast Ohio and you’re walking on what appears to be clear ground. Then, suddenly, your feet slide out from under you on “black ice” and you fall and break your wrist. Who’s at fault? Can you sue for your damages and injuries? Under Ohio law, there is generally no recovery for injuries caused by a slip and fall on a natural accumulation of ice and … Read more
